Design Reaction’s Terms and Conditions

 

GENERAL TERMS

•    All work is carried out by Design Reaction on the understanding that the client has agreed to Design Reaction’s terms and conditions.
•    In the situation where a selection of designs are presented to the client, only the final product is deemed as fulfilling the contract. All other designs presented will remain Design Reaction’s property unless otherwise stated in the brief.
•    Design Reaction will provide the customer with a written estimate, which needs to be replied to by the customer to indicate acceptance of the brief as well as Design Reaction’s Terms and Conditions.

 

WEB DESIGN

•    The client agrees to provide content and material within adequate time for Design Reaction to complete the project within the agreed timescale.
•    Design Reaction will not be held liable for costs, compensation, and loss of earnings incurred due to failure of the project meeting the agreed deadline.
•    If the client requires additions/changes to the design brief, then it is the client’s duty to notify Design Reaction as soon as possible. These requests will be considered by Design Reaction with the projects best interests in mind.
•    Design Reaction accepts no responsibility that any additions/changes are free of errors and reserve the right to charge accordingly for any correctional work.
•    Design Reaction will not take any responsibility for copy and imagery supplied by the client.
•    Design Reaction reserve the right to decline/withdraw any content seen of a copyright nature unless proof has been provided with full permission granted for use.
•    Where a database is needed, Design Reaction provide an optional data back-up facility for security, where the client takes total control and responsibility.
•    All website, design and code will remain the property of Design Reaction until payment has been made in full.
•    The customer agrees to allow Design Reaction to place a small credit on their website.
•    Whilst every measure is taken to ensure that website developments are free of errors, Design Reaction cannot accept liability of any loss encountered due to malfunction.
•    Design Reaction will not be involved in disputes between the site owner and their clients/customers for any wrongdoings on the part of the site owner.
•    Design Reaction will update sites post completion within the first 28 days where the client believes amendments are needed. Design Reaction will charge an agreed hourly rate for amendments beyond this period of time.

 

BROWSER/OS COMPATIBILITY

•    Design Reaction build websites to the standards of current and familiar browsers and operating systems.
•    Design Reaction cannot guarantee browser compatibility across all ranges and versions.
•    Design Reaction optimize the build of their clients sites to suit current screen resolutions unless specifically stated otherwise.

 

SEO

•    Due to external procedures outside of Design Reaction’s control, e.g. search engine change their performance to index and rank sites, top positioning cannot be guaranteed within search engine rankings.
•    Design Reaction provide basic on-site SEO to increase the chances of promoting the site to a larger online audience.

 

HOSTING AND DOMAIN NAME

•    Design Reaction endeavor to ensure that the client’s website will be running indefinitely.
•    Design Reaction will not be held responsible for costs, compensation and loss of earnings incurred due to downtime of any servers.
•    Design Reaction reserve the right to refuse/withdraw any material that is deemed to be offensive, illegal or controversial and terminate the remaining hosting service.
•    Domain name will remain Design Reaction’s property until the project has been paid in full.

 

DESIGN AND PRINT SERVICE

•    The customer agrees to allow Design Reaction to place a small credit on printed material, exhibition displays and adverts.
•    An indication given by Design Reaction of a design project’s duration is to be considered as an estimation. Design Reaction cannot be held responsible for any project over-runs.
•    Estimated project duration should be deemed to be from the date of deposit funds cleared.
•    All printed media will need to be paid for in full upfront before any work can commence.
•    Design Reaction will supply the client with a print quote(s) based on the clients’ requirements.

 

PAYMENT – WEBSITES

•    A non-refundable deposit of 50% is required as acceptance of any web project along with the signed off brief before any work can commence.
•    A second stage deposit of 30% is required on sign off of the design of the site.
•    The remaining 20% is due on approval and sign-off of the site. The site will go live on complete payment.
•    Payment may be made in Cash, Cheque, electronic fund transfer or PayPal.
•    A fee of £50 will be charged for any returned cheques.
•    Design Reaction will contact clients via email or postal mail to remind them if payment is not made within the allocated time.
•    Once payment is made in full, it is assumed that the project has been completed to the client’s expectation and no refund can be offered.
•    Payment in full is expected on go-live of the site.
•    If accounts aren’t settled or no contact has been made regarding delay, Design Reaction hold the right to remove the site from its online state, and pass such cases to the small claims court to pursue payment. Non-payment can result in CCJ’s being added to the client’s credit rating.
•    Where payment for hosting isn’t made within the allocated time, Design Reaction reserve the right to remove the website files and database from the server. There will be an admin fee of £60 to recover the site to its former state, which will be due immediately along with the hosting fee before the website can be restored.
•    If the client finds making payment difficult, then please inform Design Reaction immediately to discuss matters and arrange alternate methods of payment.

 

PAYMENT – PRINT & DESIGN

•    Payment for print is required in full prior to ordering of any printed media.
•    A non-refundable deposit of 50% for design services is required prior to commencement of any work.
•    Remaining balance of payment is due in full prior to Design Reaction providing the client with the hi-resolution files of design services.
•    Payment may be made in Cash, Cheque, electronic fund transfer (details available upon request) or PayPal.
•    A fee of £50 will be charged for any returned Cheques.
•    Design Reaction will contact clients via email or postal mail to remind them if payment is not made within the allocated time.
•    Once payment is made in full, it is assumed that the project has been completed to the client’s expectation and no refund can be offered.

PRIVACY POLICY

•    All work carried out by Design Reaction is backed up to external media in the event of any mishaps or hardware/software failure.
•    Design Reaction do not share/sell clients’ details with any third party companies.
•    Design Reaction will keep clients’ details privately and secure with use for:
–    Internal record keeping
–    Contacting clients for information on improving services
–    Send promotional emails regarding new services and offers

 

COMPLAINTS (informal)

•    If you encounter any problems, please contact Design Reaction urgently to discuss matters. The client must provide the nature of the complaint identifying the grounds for complaint.
•    Design Reaction will approach the client to discuss options available to rectify the issue.

 

COMPLAINTS (formal)

•    A formal complaint may be raised when the client feels the matter to be too serious to be dealt with informally, or following an informal complaint where the client feels that the issue has not been resolved.
•    A formal complaint should be made in writing to Design Reaction who will acknowledge and ensure the matter will be looked into immediately.
•    Please allow 7 days for an initial response; a full response and the issue should be resolved within 30 days.
